A Nairobi businessman has been charged with stealing property worth Ksh25 million from a widow and her three orphaned children.
Tom Waiharo Njoroge, the director of Mass Labs Limited (MAL), was accused of illegally taking over the estate of the late Joseph Santet Ole Shoona between April 2021 and October 2025.
He appeared before Senior Principal Magistrate Lucas Onyina at the Milimani Law Courts, where he denied all the charges.
Prosecutors told the court that Njoroge forged company documents to transfer ownership of the deceased’s assets from Mass Labs Limited to another firm known as Apex Projects Limited.
He allegedly presented fake company records and agreements to the Registrar of Companies at the Office of the Attorney General.
The court heard that the forged documents were meant to show that the transfer of ownership had been approved by one of the estate’s administrators, Lawrence Litein Shoona.
However, investigators later discovered that the signature used on the forms was fake.
According to the charge sheet, Njoroge also violated succession laws by handling the estate without the consent of the administrators Lawrence Litein Shoona.
Caroline Lipaso Shoona, and Lois Shena Shoona who are the legal representatives of the late businessman’s family.
He is further accused of creating and submitting forged agreements claiming that Apex Projects Limited had legally acquired Mass Labs’ assets.
The prosecution stated that through this fraudulent process, Njoroge transferred all company assets valued at Ksh25 million to himself without proper authorization.
The Office of the Director of Public Prosecutions (ODPP) filed five charges against him.
Including theft of property, forgery, uttering false documents, and breaching succession regulations.
Njoroge pleaded not guilty and requested to be released on bail, promising to attend all court sessions.
The prosecution did not oppose his release but asked the court to impose reasonable bail terms.
Magistrate Onyina granted him a cash bail of Ksh500,000 and ordered the prosecution to provide the accused with witness statements to help him prepare his defense.
The case will be mentioned again on November 13, 2025, when the court is expected to set hearing dates.
Until he pays the bail, Njoroge will remain in custody at the Industrial Area Remand Prison.
